Service Description

Indiana Pest Control provides residential and commercial pest management services throughout the state of Indiana. Our services include, but are not limited to, inspection, identification, treatment, prevention, and monitoring of common pests such as termites, rodents, ants, bed bugs, cockroaches, spiders, mosquitoes, and other nuisance wildlife. Treatments may involve the application of EPA-registered pesticides, baiting systems, exclusion techniques, trapping, and integrated pest management strategies tailored to the specific conditions of your property. Service frequency varies by program and may include one-time treatments, monthly visits, quarterly maintenance plans, or customized schedules based on pest pressure and environmental factors. All services are performed by licensed technicians in accordance with Indiana Department of Environmental Management regulations and applicable federal guidelines. We reserve the right to modify treatment methods, products, or service protocols based on seasonal conditions, pest biology, regulatory changes, or property-specific assessments without prior notice.

No Guarantee or Warranty

Indiana Pest Control makes no express or implied guarantees regarding the complete elimination of pests from your property. Pest management outcomes depend on numerous variables beyond our reasonable control, including but not limited to structural conditions of the building, surrounding environment, weather patterns, neighboring properties, sanitation practices, and pest reproductive cycles. While we employ professional methods designed to significantly reduce pest populations and prevent reinfestation, we cannot warrant that pests will not return or that new infestations will not occur following treatment. Any verbal assurances made by technicians or representatives do not constitute warranties unless expressly documented in a signed written agreement. Customer satisfaction commitments, where offered, are limited to retreatment of treated areas within specified timeframes and do not imply guaranteed results. You acknowledge that pest control is an ongoing process requiring cooperation, environmental management, and in some cases multiple treatment applications to achieve satisfactory control levels.

User Responsibilities

As a customer of Indiana Pest Control, you agree to provide accurate and complete information regarding pest issues, property conditions, prior treatments, health concerns of occupants, and presence of pets or sensitive individuals. You must ensure safe access to all areas requiring treatment, including basements, crawl spaces, attics, and exterior perimeters. Prior to service, you are responsible for securing pets, covering food preparation surfaces, removing children's toys from treatment zones, and informing technicians of any chemical sensitivities or allergies among household members. You agree to follow all post-treatment instructions provided by our technicians, including ventilation requirements, re-entry times, and cleaning restrictions. Failure to prepare adequately or comply with safety protocols may result in service delays, additional charges, or reduced treatment effectiveness. You must notify us within the specified timeframe if pest activity persists or if conditions change that may affect treatment success, such as new structural damage, water leaks, or introduction of infested materials.

Limitation of Liability

To the fullest extent permitted by law, Indiana Pest Control and its employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, loss of use, lost profits, or emotional distress, even if advised of the possibility of such damages. Our total cumulative liability for any claim related to services rendered shall not exceed the total amount actually paid by you for the specific service giving rise to the claim during the twelve-month period preceding the event. This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise. You acknowledge that pest control treatments involve inherent risks, including potential exposure to pesticides, and you assume responsibility for following all safety instructions. We are not liable for damages resulting from your failure to comply with preparation or post-treatment guidelines, pre-existing structural defects, or acts of third parties.

Intellectual Property

All content, materials, and intellectual property associated with Indiana Pest Control, including but not limited to our company name, logo, service marks, website content, photographs, treatment protocols, written reports, and proprietary methodologies, are the exclusive property of Indiana Pest Control or its licensors. You are granted no right or license to use, reproduce, distribute, modify, or create derivative works from any of our intellectual property without express written consent. Inspection reports, treatment documentation, and customized service plans provided to you are intended solely for your personal, non-commercial use in connection with the property addressed. You may not transfer, sell, or disclose such documents to third parties for commercial purposes without our permission. Any feedback, suggestions, or testimonials you provide may be used by Indiana Pest Control for marketing and promotional purposes without compensation.

Governing Law

These Terms of Service and any disputes arising from or related to services provided by Indiana Pest Control shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these terms must be instituted exclusively in the state or federal courts located in Marion County, Indiana, or the county where the services were performed. You hereby submit to the personal jurisdiction of such courts and waive any objection to venue or inconvenient forum. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision of these terms is held invalid or unenforceable under Indiana law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Changes to Terms

Indiana Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason. Changes become effective immediately upon posting to our website or other notification methods. Material changes affecting your rights or obligations will be communicated to active customers through the contact information on file, where feasible. Your continued use of our services following the effective date of any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically. If you do not agree to the modified terms, you must notify us in writing and discontinue service upon completion of any prepaid period. No oral modifications to these terms shall be binding. The version of these terms in effect at the time services are rendered shall govern disputes related to those specific services.

Written notices required under these terms shall be deemed given when personally delivered, three business days following deposit with a nationally recognized overnight courier, or five business days following mailing by certified mail, return receipt requested, to the most recent address on file for either party. Electronic communications to addresses provided during account setup constitute valid notice for non-material communications. We strive to respond to all inquiries within two business days.
